Renée Popovits recently contributed a chapter to a book for UCLA. Her portion discusses the dilemmas of disclosure for counselors and the legal issues that surround it. She focuses on the fundamental legal principle underlying substance abuse treatment: confidentiality. This Chapter highlights key provisions of the two sets of federal regulations establishing the national standards for confidentiality and privacy: the federal confidentiality regulations (42 C.F.R. Part 2) and the Privacy Standards promulgated under the Health Insurance Portability and Accountability Act (HIPAA). Although states may have more stringent laws, these federal regulations serve as a guidepost for legal compliance.
